Is his name on the mortgage that you refinanced or just your name? You refinanced to pay off his and his mom's credit cards? And then they left you to pay the mortgage? I hope I understand this, if his name is on it, he has to help pay or his credit will be ruined among other things. Are the kids, HIS kids? If they are doesn't he want them to have a home? Even if they're not his kids, he should have a heart and help them and you have a roof over your heads. Whichever would be quicker, I would do between the divorce and court, because you can't mess around and not pay your mortgage. I guess if all else fails, sell the house, get a divorce and start over?!
