I found out that my best friend since childhood and my husband of 10 years were having an affair for a year. I had my suspicions, but they always said nothing is going on. I told myself they'd have to get caught first before they would admit anything. Well I finally caught them.

I beat up my so called 'best friend' and now is threatening me that she'll call the cops and charge me for assault. I was wondering, what does the government do for the wife who is has been emtional hurt by all this? Nothing? I get charged for assault while she goes free for being a b*tch? My husband is another matter.

Ok Bethany first of all I understand your situation.
It depends on what state you live in but there are states that still have adultry on the books, they dont always go after the cheaters but the laws are there.
You could sue her for allienation of affection for sure, women have won this suit in this type of situation.
You need to talk to an attorney concerning divorce & suit against them for adultry and allienation of affection, emotional distress etc
You also need the attorney to possibly represent you if she tries to have you charged with the assault & battery.

Im sorry your having to go through this, I know its awful on many levels, but you will get through it. Stay strong and fight for you!!!

There used to be laws against adultery in the US in the old times. Most have been repealed but some jurisdictions may still have them on the books but doubt that they will prosecute on this basis.
You beating up your "friend" is a separate matter. It was an assault. A criminal offense, for which even if in your jurisdiction there was such a law against adultery, it would not be a defense. So you could be prosecuted for it. You would need an attorney who would argue mitigating circumstances to lower your sentence. If you have a clean record will probably just get probation. But dont be surprised if a cop knocks on your door...

If you have evidence of the adultery, in some jurisdiction it is helpful during divorce proceedings to get more favorable terms when it comes to division of wealth.

I know what they did to you was awful but control yourself because these two have hurt you enough already, dont give them the power to also get you thrown in jail. No more physical assault!

This is a rotten situation and I can sympathise, but I think you should make sure you do not keep a record of this question on your computer, because you have admitted to assaulting this -- this person who claimed to be your friend while she cheated on your trust...

Anyone can lose her cool and I don't blame you. You know that violence is not good but I see what drove you over the edge.

I cannot advise you on the law, but I do know that it's not a good idea to make written, public admissions that could be tracked back to you. It seems she has so far only threatened to call the cops so it might be wise to clear things up while you can.

My own 'advice' could also be faulty or even not very legal. I don't know. It might be wise to talk to a lawyer. I can't see any harm in telling you that. But please, don't get into any more physical conflicts or things will just get worse.

You do need to contact an attorney as soon as possible.
She CAN have you charged with assult. The assult charge and the adultery charge have nothing to do with each other.
To answer your question directly. YES
Adultery IS illegal and you CAN go to jail for it. Although, most of the time, that doesn't happen.
You will be able to get just about anything you want in the divorce tho.
As far as the assult, it is completely seperate and you will have to deal with that seperately. The judge won't excuse it under the circumstances. (although he may go easy on you).

well 1 thing is try not to beat up on your friend so much. just drop the friendship like it is. i mean she obviously knew the intentions if she got caught and obviously wanted to get caught. but maybe did u ever think that she may have wanted to get away from her own love life maybe hers was becoming difficult and hard and the only pleasure she found was well being with your husband. i know thats not an excuse or anything but maybe thats all she thought. and in technical terms adultry is not illegal. butr in the bible it is. so whatever law you belive is ok but i hope you your best friend and your husband can work something out and if you can't maybe it wasn't meant to be best of luck bethany

No it just a crime in gods eyes.....committing adultery is not a law if it was then 98% of the world would be locked up....if she pressed charge on you, you would get charged with assault and she would go free.

You physically assaulted your friend? I can't believe that an adult would take things to that childish level. Didn't you have any hints that something was going on?

Consult an attorney. Lay people don't know the laws.

You did make a mistake by taking the law into your own hands. If she sues you you can spread her deed all over town and if there are children involved you can make a real fool of her and the husband legally and otherwise. Go for it gal, they both deserve both barrels.

No, adultery is not illegal. It can be grounds for divorce, though, or a civil lawsuit.

Except for the US Military, under the UCMJ it is illegal for a member of the armed forces to engage in adultery.

Best thing to do is get a laywer and file for divorce. He's not worth your time.
