I have an 8 year old girl from a previous marriage. I am trying to modify the visitation and child support fairly under AZ state law. My ex was involved in a vehicle rollover and my child was involved too. My child is 130lbs (at 8) and was diagnosed with obesity. My ex was informed by doctors since the child was 4. She is eating the wrong foods (mcdonalds, BK, etc.). All she does is complain about me. I have medical records, school records, police reports, welfare fraud report, etc. about my 8 year old. I am clean, not even a traffic ticket. I have been raising a baby from my current wife by myself.....Healthy boy. Doctors records to prove it. My question is this.....Can the Judge grant me custody of the 8 year old even if i am not asking for it?

Ex was given a misdemeanor on attempt to commit wefare fraud. She was charged with 5 counts.

I don't know the Az. law about this, but if there was to be a child protection case started in the courts and the judge felt that removing the child from the mother's custody was in the best interest of the child, the likely first person who would be asked to take the girl would be you, the father. Wouldn't you rather take your daughter yourself than have her placed in foster care with people she doesn't know? You have made a case in your post for why you are fit to raise her, so if it comes to an out-of-home placement for her due to neglect issues, it may be possible.

The judge cannot rule on any motion that is not in front of him/her. If your ex has custody, then you will have to ask for it to get the ruling.
