I (as well as my mother) am trying to file a PPO against my stepfather, becuase he is threatening and being violent, he is also stealing things (a car) from my home and yard, i filed a report with the police and they have done nothing. I also went through the court to get a PPO and all they granted was that he could not own a fire arm and he couldn't threaten me anymore. So he still goes up and down my road being fowl and down right mean. He is still stealing from us. He has even gone as far as stopping people driving down my road just to tell them really nasty and untrue things about me and my family. I need some kind of help stopping him before he gets any worse. All Oakland county as well as the Judge keep telling me is he isn't breaking the law. But this has been going on 2 months and i need it to stop, if not for me and my mother but for my three year old little girl. If anyone has any kind of genuine advise I would truly be greatful.

Unfortunately there is very little the police can do to keep him from driving on the street where you live. City streets are public places and he has the right to drive on them. He is not breaking any laws. Just because he acts in a manner unacceptable to you is no cause to arrest him. A PPO can only keep him off of your property and away from you physically. If his name is on the title of the car he is not stealing it. Threatening to be violent and being so are two different things...most people will in the heat of anger tell someone "I'm going to kill you" however they have no intentions of doing so, if the police arrested everyone for saying such there would not be anyone living outside of prisons. If he calls you, have your phone number changed and have it unlisted, purchase an answering machine and turn the ringer on your phone off or down to where it can't be heard, when the machine picks up a call you can choose to either answer the call after hearing who is calling, wait and return the call later or erase the call soon as the caller hangs up. Also you could get caller ID for your phone. Until he actually breaks the law there is nothing the police or courts can do, it's not their fault...it is the fault of the voters who vote into office those who make our laws. The police and the courts are only here to enforce our laws not make them.

So everytime he does such actions, call the police!!! Get a restraining order on him. Is your mother divorced from him? This may help. If he's being violent and stealing, they have complete control of whether or not anything is done to him. If you feel that he's a threat, especially to your daughter, call the police when you see him come around. Even if he's not doing anything, just call the police dept. and tell them you and your daughter feel very threatened (your lives feel threatened) by him and would like for him to not be able to enter your neighborhood at all. I don't know what else you can do. Maybe take it to a higher court....supreme or something??? If your state isn't doing their job, someone has to before someone gets hurt!

I had something like this happen once and although it sucks I moved. I got a restraining order keeping him farther away which meant he couldn't drive down my street and that didn't work so we just moved and we did it fast and when we knew he was at work so he couldn't follow us. I even provoked him hoping he would do something really stupid so I could put him in jail. I am really sorry that this is happening to you and I hope you find a way to make it stop. Hang in there because the stupid will eventually wear off and if you don't give him reaction then he will give up sooner or later. Make sure you put your cars in the garage or start leaving them at a friends that he doesn't know about and taking a taxi or asking the friend for help. HE WILL GIVE UP sooner or later.
