We bought a used Car only to discover a week or two later that is had been in a front end collision. To the extent that the body shop we took it to pointed out 20 repairs that were not done correctly including a bent frame. This dealership did not tell us this fact they also had not reported it because its carfax came out clean. Does this constitute the right to give the car back and have our down payment refunded?

If you can prove they new the car was in an accident and that they covered it up yes. It would be fraud but that will be hard to prove. Have you called them?

When you buy a used car, you buy AS IS. If you're buying a used car, take a car person with you to look at it. Another option is to pay the ten bucks and get a Carfax report, it might save you a lot of headache. The dealership simply asked a price they thought appropriate for the car, and by paying it, you agreed. You can't change your mind now and say the price was not appropriate. It is your responsibility to make sure the car is up to your standards BEFORE you puchase it. As far as legality, you have dealership which will claim the car was repaired properly, and you have your mechanic that wants to do 20 repairs. Truth is, there are a ton of mechanics that will want to do 20 repairs to a car that is perfectly fine. You wont have much chance in court.

The lesson here is that dealerships make their money from used car sales, not new cars. They will get them on the road as cheapley as possible, and sell them for every penny they can get. DO NOT BUY USED CARS FROM DEALERS. You may get a "certified car" or a powertrain warranty, if it helps you sleep at night. But did you know that crankshaft position sensor is not covered by a powertrain warranty? The engine wont run without it, but warranty doesn't cover it. I just stumbled across this when repairing a friends car. It made me wonder what else was NOT covered.

Bottom line is, when buy a used car, you get them much cheaper, and often in better condition when you buy private party. Just take a good mechanic with you when you go to look. If you don't know any mechanics, get a Carfax.

NOPE! the dealership did nothing wrong, the car fax reprot was clean - so the liklyhood of the dealer knowing about the extent of the damage is slim...
although - if the dealer is reputable they should try and get you into something else then wholesale that car.

if there really is damage to the frame the used car tech should have found that

i really like nitrojunkies comment - "dont buy from a dealer" - like a private party seller has warranty - and yes - you can buy extended warrantyies and no they do not cover everything - if you want everything covered - buy a new car

if the car was logged as a write off then repaired you must be informed but if it was crashed and not logged(not reported to dvla or insurance company) then on paper the garage that sold you the car legally didnt know although they mite have noticed and said nothing but i cant coment on that as i dont know there reputation
