In layman's terms it is a specific stipulation written into an agreement/contract.

For example, say you put a piece of real estate under contract. You could add an express provision that gets you out of that contract under a certain circumstance.

Btw, some states recognize verbal express provisions as long as there is ample proof of them... ie, witnesses.

An express provision is one that is expressed (written) in the contract.
As opposed to an implied or assumed provision.
