I think you would have to be a sovereign nation. If you happen to be .... i say its legal and that any deaths would be due to the war. make sure to reduce calateral damage, and just hire a sniper to end it. It cuts down on the shrapnel damage to your house.
I think its a great hint for him to move out tho....
"I _(insert name here)_, formally declare war on you, __(the name of the soon to be deceased)__. Any and all hostilities after this declaration will be directly related to whether or not you have been successfully terminated. Failure to be terminated will result in further violence from any and all of my agents or representatives. Peace can be brokered between our warring factions for an annual sum of half your income."

It would be homocide. Only governments can declare war, its not up to individuals. Land mines are an explosive device and generally private ownership is prohibited by law, the BATF would surely want to talk to you. Why not just divorce him? Not a crime, he may have to pay support, and you'll be rid of him without going to prison.

Since you are not a sovereign nation it would still be murder and it may even fall under the new laws pertaining to terrorism. I must applaud you for you imagination though;)
