Most retarded people go to work 9-5, pay rent and drive a car. A 90 IQ is highly functional in our society generally until you get down to the 70's you're not wearing a helmet on the bus unless you also have autism or other birth defects that go hand-in-hand with retardation. There are cases where retardation is so severe or compromised by other mental disorders that they become effectively a ward of the state and have the rights of a child, this can also happen with mental patients if they are deemed to not understand the consequences of their actions.

Yes.
Generally, when prosecuting someone for any sort of inappropriate sexual contact with a mentally impaired "victim" who may have given consent, the victim is given tests to determine whether they were capable of giving meaningful consent or not. There is some ambiguity in the law, imo, but, certainly courts have upheld the decision of mentally challenged people to have sex on many many occasions even in the face of opposition from primary care providers.

Yes I think he/she can legally give consent to sex if :
1)his/her retardisation is not so seriously,he/she can do a limited work independently
2)his/her parents have enough wealth so he/she will be inherited for his/her long life in this world
3)he/she is healthy and can care his/her own child well
4)he/she has a skill for earning his/her own living
5)he/she has chance for having spouse
