I think i should add that there was a real estate broker involved. he placed lock-box on door. can still come and go though. real estate agent accepted 1600.00 cash and asked for 500.00 to be mailed to him in his name not name of realty company.threatening to show apt while we are still in it

You should have a number and receipt for money order to verify it was never received.

This is a very vague question. First, I'm not sure why the money applies to the situation at all unless the landlord is claiming that you are not a valid tenant for whatever reason and is intending on removing you from the property. If this is the case you definitely need to find a money order receipt of if you know the name of the place you bought it, the date, the amount, you can contact the money order company and believe me they can find it. It will be a lot of tedious stuff but they can do it. Secondly, if the property has been put up for sale which is sounds like to me based on the fact that there is a lock box in place, there is really not much you can do about it unless your particular state or town has a statute regulating landlord entry, etc. It should also state somewhere in your lease regarding landlord entry and terms surrounding it. They should give at least 48 hours notice before entering your apartment for showing unless some other arrangement has been made. If you are concerned with your belongings, etc, I would invest in a hidden camera. You can actually rent them without buying, or if you have a webcam on your computer a lot of them have motion activation programs you can get free on download.com or other sites and put your computer in a spot where it can catch most things and do it like that. If you mean that he locked you out, no he can't. He has to file for eviction, unless of course, the lease did not come into effect until receipt of the money. In that case, you have no lease, b/c you didn't fulfill your end of the contract.

You may be able to get your deposit back, depending on the real circumstances, but it sounds like your SOL. You will be responsible for the month's rent that he lost b/c you breached the contract.

Next time, don't sign a lease unless you have all the money and can write him a check right then and there.

Locking a property after lease is already valid is illegal. Technicalities should not apply in this case but the two parties must amicably settle the issues.

Your deposit should secure your rights,unless there is a clause in the lease,showing otherwise.Read the fine print,then retain a lawyer or small claims court.

Then you have not paid them all the money needed yet. You need to pay the balance of the money or you have not paid the needed money.

So yes untill you pay the 500 you have not leased it yet.

He can't do that.... get legal help and do not make the money order out in his name. Get legal advise !!!!
