Not sure to be exact. Could depend on the state or country you are trying to sue in. I tried to once for an employer that never paid me and the others. Well I waited over 2 years to file and was told by the courts that if it was over 2 years ago, it was too late to do anything. That's from my personal experience here in Texas.

Depends on your state, what form of agreement you had (paper, verbal), whether the other person declared bankruptcy and what kind of bankruptcy is was, and other fun things.
