I dont know Cal.divorce laws exactly but the majority of the states are the same. Basically, unless the mother can be proven unfit usually for child or drug abuse, via police or medical reports, she is named resident parent and awarded custody of the children and the other parent, the non resident parent is awarded the states mandated child visitation rights. Now in an uncontested divorce, if both parties can sit down civilly and work out the details, this is beneficial to both and different details could be worked out which the judges love instead of leaving it to the court. Now this is just basic child custody without details so if you can get hold of a paralegal, he can advise you without the high cost of an atty. Good luck
