i had a business a fews years ago and the insurance company is suing me for premiums i never incurred to the levels they are claiming.
can i insist on mediation instead of "trial"?

You are not giving us enough info to give you a better answer. You may or may not have some personal liability. You may or may not be entitled to mandatory arbitration under the insurance contract. But you may not want it. If you are being served only as the last surviving director of a defunct co. with no assets, you are only liable to the extent you received assets from the co. without consideration. So you may be better doing nothing. Or maybe not. If that's confusing, see an attorney & bring him the summons & complaint. S/he can give you a better answer.
