See a lawyer. You are probably entitled to the bulk of the estate unless she left a will.

Blood is thicker than water? Yeah, right! The same thing happened in my family.

You have legal rights to her money. Is there a will? If so, the probate court will make a ruling. Is your father alive? It depends on State law, but your father will probably inherit the entire estate if he is still alive and there is no will. You and your siblings will probably inherit the estate if your father is deceased and there is no will.

People always forget about this, but money held in bank accounts follow their own rules. If your Mom held a joint account with someone else, the survivor (the joint party) gets all the money. If she was trustee for a beneficiary then the beneficiary gets all the money. If the account was owned individually, then you have to wait for probate. Remember that different bank accounts may be held in different ownership categories. And that she might have frequented had more than one financial institution. Gather up all the mail and sort them. Most financial institutions will send out monthly or quarterly statements. Don't forget to check for 1099 forms at year end.

Most states have some sort of "Affidavit to Claim Property of a Deceased Person." Basically, you can claim your mom's estate if it is less than the limit set by the State. You'll need certified copies of her death certificate. Each bank, savings and loan, insurance company, stock broker, etc. will require a certified copy. Order many extra because photocopies are not acceptable.

Don't sign anything your aunt or uncle give you. You should see a probate attorney. Don't give your aunt and uncle anything more than a Christmas card during the Holidays!

I know you said what they can do with the money, but you shouldn't let them STEAL what your Mom left for you.

Good luck.

First of all your mother's will decides who gets what money. If your mother didn't make a will the money is split up according to the law, not what some greedy, low-life aunt and Uncle say.
If they already took the money you can sue them as it was illegal for them to do so.
Money has a way of bringing out the worst in some people, and in this case the Aunt and Uncle have demonstrated that they have ZERO class, are selfish and greedy.

Did your mother leave a will? If not the money/land/stock, EVERYTHING automatically goes to the children. See a good lawyer ASAP! Your Aunt & Uncle clearly are greedy, selfish and uncaring people, don't let them win. Good luck honey and I'm sorry for the loss of your mother AND how your Aunt and Uncle behaved.

Tis funny, as the person says above, they ain't getting a bean unless it's written in the will (Goes to the spouse, or if they're dead, then the children). Personally, as i'm gathering your relatives aren't looking after you (you ain't thier dependent) I would tell them to leave, get stuffed, and not return. Not even to the funeral. They can spend the rest of their lives knowing they couldn't say their final goodbye's because they were too greedy.

That's so disgusting! Unfortunatly, some people are like that and there isn't anything you can say to change them, but you could talk to an attorney and sue the bast@rds. Very sorry to hear about that!

Sorry you have such a shitty Aunt and Uncle! If you were my nieces/nephews her inheritance would go into trust for all of you until you came of age. It is YOUR money...not theirs!

For one thing that was not the time to approach you with that decision. And besides it's not their decision. The inheritance legally belongs to her children. Unfortunately some Christians use the name Christian just to get over on people. You will probably never be able to get those heartless people to see anything but their own greed. Sorry for loss.

if she didnt leave you anthing in writing can contest and win the case, under most states laws, you are required to leave your children at least one dollar or they can contest everything, get them.
