Hi I was wondering, I want to file bankruptcy but one of my creditors has already started legal action against me. Can I still put them down as part of the bankruptcy claim or is it too late. thx

Yes you can, you can also call them and tell them that you are filing bankruptcy, give them the name and number of your attorney and by law they have to quit calling you. At that point they are only allowed to contact the attorney by federal law.
if you havent talked to an attorney yet, most creditors will give you a month to get one before they call again to get the info.

Add them to your list of creditors. Don't pay them anything until the court decides your bankruptcy case. Once you declare bankruptcy, they have to stop trying to charge any additional interest.

i think the laws are different in each state
but i believe in Massachusetts you can put who you want and keep what you want to continue paying on
the federal government just made some changes on bankruptcy
call a lawyer and just ask the question
