The solution to this problem is to prepare some written cards and take them with you whenever you go to a restaurant. That way you are prepared in any situation with the appropriate response, which you simply pull from your pocket, and wave in his face. Suggested notices would read something like:
1) Yes thanks, everything is great
2) Not really. Come back in a few minutes
3) No. Get me the manager now.
4) Leave now, or forget about receiving any tip
5) Stand back, I am about to vomit.
Works every time!

As a server I can tell you that I always try to wait until someone at the table isn't chewing, but some people eat so fast there is no time to check on them when they don't have food in their mouth!
Usually it happens because a server doesn't usually have the time to wait for just the right moment, because there are other tables that need their attention,too.

they are required to check when it appears you're in need of a refill which usually means you're in the middle of your feast.
:D
of course you'll be chomping down when that happens but it's better than sitting there going... "ok i still have a meal to finish but i'm out of cola, wine, water, tea?...."
there's never enough fluids and they know that and while they're doing that they'll ask you what you'll also need in case you want additional items.
most times you can say bring the wine list or dessert list.. they'll do that and most times that'll give you a wee bit more time to chow.
knowing you'll be thinking about a secondary meal while you're there.
ways to extend this is to get jugs of the drinks you want that may cut the 'is all ok' queries by half.
i don't mind it, i like it when they're around my feet beckoning to my every wish.
a good waiter will have the coffee, soda, water ready for you and ask.. then they fill you up, ask if you need additional items and then cycle around for the next query.. good waiters do that the lousy ones let you hang until you crack in half with dehydration or shrivel away in starvation.

Its probably because they have several tables they are waiting on and they don't have time to watch you to see if you have food in your mouth or not. I'm sure they don't do that on purpose. Put yourself in there position. Say you have 10 tables to wait on, each table has 2 to 8 people setting at them. Do you really think your going to have time to watch every person at every table to see when they have no food in there mouth. No of course not.

they probably do that, so if your mouth is full, in the few seconds it takes them to ask you by the time you have finished your mouth full, they have already walked off. Basicly saves time and hassel for them as they probly have to be seen as they care. lol

They're on a minimum wage and have to work unsocialable hours, aren't they entitled to have a bit of a laugh with their customers. Nothing compared to what the chefs get up to.

its because they need 2 find out if everything is ok with your food its just bad timing if they r walking behind you they cant see if u r eating.

I hate that too! They always do that. I think they enjoy it. They also love to bring your food two minutes after you got the appetizer.
