I ask because Hitler did the same thing. If there was a law in place that would not allow him to do what he wanted then he would just change the law. The U.S. Supreme COurt has ruled that military tribunals are against the law. So Bush is going to have the law changed to fit in with his world view. I am wondering how much longer it is going to be before people realize that his has been done before. Look at History people of America Hitler did this same thing in the late 30's and early 40's. When are we going to say enough is enough? A concerned American Citizen

I understand the way in which the government works but the Congress has yet to stand up to Bush. And you would have to get the law in front of the courts in order for them to over rule the law and if these guys have no rights it will not get in front of the courts.
And Chase we as Americans should not lower ourselves to the level of th eenemy we should treat them better than they will treat us if we are to take the moral high ground. And as for getting info from them if we have to get it by torture is that what we want? We want to torture people and erase a proud American history of being moral leaders in the free world. I guess I am lost .
Also, the Supreme court did rule against Bush's holding Military Tribunals for those detained in Gitmo. Furthermore, it was a question and not an open door for personal attack. But, I guess the attack is the only way some people can discuss issues.

You are right David W. we are not in the same shape as Germany was when Hitler came to power. But, I guess some of you in here are ok with NSA wire taps, checking library records, email , and any other thing they are doing. I guess some may say if you have nothing to hide then you should not worry. But, Ben Franklin said " those willing to give up liberty for safety and security deserve neither." I do not think we can negotiate with terrorists. But, I WILL NOT CONDONE THE TORTURE OF ANY HUMAN BEING.... If this makes me a liberal than so be it. I think that if we are going to hold the men in Gitmo until the conclusion of the war fine we have done that in the past. But, after the war they need a trial. And then what if we have little or no evidence to convict then what do we do all we have done is to make a new terrorist for our country I do not know what the right answer is. But, I do know we need to treat them as we would wnat to be treated. Those that do not agree must be christians.

The holding didn't say all military tribunals. It said any that are not regularly constituted according to established principles, meaning that any such tribunals must satisfy due process requirements.

And the Court also said that Congress could establish additional courts/tribunals, using its Article I powers, and that once established those tribunals could be used, again as long as they follow the rules of Due Process.

{EDIT to DavidW} The Supreme Court doesn't have jurisdiction over the military? What reality are you living in? Where do people come up with nonsense like this. Do you never bother to read the Constitution, or the Supreme Court holdings, and just guess?

{EDIT to Chase and P_L_Gray} Actually you are incorrect. Read the actual laws, and the Supreme Court holdings relating to them.

And for those who still haven't bothered reading the Constitution, 5th Amendment due process requirements and 6th Amendment protections apply to anyone, not just citizens. They are limitations on govt action, regardless of who the govt is acting against. That's been the Court's interpretation for most of a century, so catch up please.

FDR did the same thing in WWII also. Or don't you remember that part?

The fact is that we are at war with these people that want to kill us, we can't be nice to them and ask them "Please don't kill us anymore ok? Here is some food and money, and do you want to fly first class back to your training camp?"

How in the heck would that win a war? It is time to use some common sense here, it is not hard. We can not negotiate with terrorists, when their opening offer is "we want you all to die". They will always win. Why do we have to give them rights that they are not giving to our prisoners, and why do liberals love these terrorists? They would kill you just the same.

This whole PC culture has gotten way out of control. If a person like you was ever elected into office, the US would be gone in a matter of months. Although, that is probably what you want, since you hate it so much. Don't try to fool anyone saying that you are patriotic, because from your comments, there is no other conclusion to draw.

Look who is attacking, have you ready your question or not? Open debate? There is no such thing to a liberal. You will ignore the evidence that proves you wrong. That is the definition of a liberal these days.

Bush has no power to actually change the law, what you should be afraid of is the judicial brach gaining power by creating legislative decision instead of whether it is uncoinstitutional.

Supreme Court has no Jurisdiction with the Military, the legislative and the executive braches run the military. You need to study your history a whole lot better Germany at the time Hitler took over is not where we are at today- not even close. The way in which Hitler took over is no where close to How Bush was elected in. Stop listening to what everyone is just telling you and really look it for yourself.

Since when does the president have the authority to change a law????

The Supreme Court did NOT rule that military tribunals are against the law.

I'm sorry to say we have almost another 3 years of this man . Lets pray that he doesn't mess up any worst then he has already and hope that God can guide him to the right path , before we all have to pay for his mistakes .
We can try to set things back on track by voting this Congress out and a new one in .

How can Bush change the law?
Congress must pass the law, then the Pres signs it... then the courts can over rule it..

The detainees at gitmo dont have any rights. the geneva convention applies only to POW's and terrorists dont apply because they dont fight for a head of state. Also they dont have constitutional rights because they arent american citizens. so it doesnt bother me because we can get information from them.
