My husband and I got custody of his 3 children over a year ago because the childrens mother decided to enter into relationship with an individual who had been convicted of child abuse before. My husband is in the military and we recently got orders to move to Japan. Due to this move can the children be removed and placed back into the custody of their mother? In Georgia where this is taking place, the move is considered a "material change in circumstance" to warrant a custody hearing again. Can they take them away and remove them from us and their 1/2 brother, due to my husband following his orders. Is there any protection for military members who have custody and have to PCS? Please help, losing my mind and maybe my children.

I would strongly urge to seek a lawyer to answer this question and what rights you do have. I know for me in my divorce with my exhusband I got custody of our child but I always put into the decree that I am able to move anywhere including out of the country .. In addition PCSing into another country make sure when he submits the Command Sponsorship to include your divorce decree showing you have custody of the children - needless to say that can cause issues with getting approved. Something I found out when we moved to Germany and thankfully I had that information after weeks of being put off and being told it was something else.

Contact an attorney... I also believe, as Eternal Love stated, that if it's apart of the divorce decree or custody/visitation agreement that you can take the children out of the state/country then you should be fine.

But with this new hearing you're talking about I think that statement is missing. If the mother is still involved with the child abuser, I would say your chances are outstanding to retain custody and take them with you. My wife and I were able to take our children from her first marriage out of Georgia because her ex was convicted as a sex offender.

I think the age of your children are also important; they may be allowed to state to the judge who they prefer to live with.

I am a military brat and now a military wife. I also grew up overseas. I am not an attorney however. All I can advice is that you see your Jag officer or Legal for help with this. If the mother chooses to challenge custody over this then they should have the knowledge to fight it.
