her biological dad has 1 day a week visiting at the moment till she goes to school but me and my husband want to move over to ireland. we are currently living in birmingham about half an hour away from her dad. i do not have issues with her seeing him but we have good work opportunities over there and she would have a better life over there. if anyone has any legal knowlege i would be very gratefull as i have spoken to citisens advice and they dont really know!!!!

i moved from birmingham to northern ireland in january with my fiancee and my 2 yr old daughter. its the best thing i have ever done our whole lives have changed my daughter is so much happier than what she was in brum. we lived in chelmsley wood ( a crap area). i think n ireland wud b ok for you to move to as is still classed as uk, but southern ireland im not sure try looking on the web for a solicitor in ireland who can advise you over the phone as they have different laws/policies over there. good luck

I don't care what the law says, but morally you should not take her away from her father. Of course I realize this is all about you (nix the bit about her having a better life) The solution is to give custody to her father and you deal with finding ways to visit her.

If her bio dad has parental responsibilty, you can move anywhere in the uk without any problem. Outside of this he has to give his permission. If you're moving to N Ireland or he doesn't have parental responsibility, theres no problem. If it's the Republic of Ireland you're going to have to have a chat I'm afraid.

You need to see your solicitor ... He would have all the details of visiting rights in the divorce papers and can advise you. If the rights prevent you leaving the country, you'll have to go to court to get permission to take your daughter away. I bet your ex will fight it all the way first though!

I'm not sure about all the legal stuff, but I do know that there are laws, if the father wanted to protest, that would not allow you to move more than 100 miles from him.

Im not sure where you are from but here u have to have permission from the father or he can get a court order to stop u. if u leave anyway it is considered kidnapping custody or not. if he doesnt consent u can still get it settled in a family court

You will need to check your divorce papers, and talk to your ex. Hopefully you parted on good terms, or have good terms by now, and as long as he got to have her for maybe extended periods in the summer, probably no problem. Check with your attorney...

this is a question that you have to call your county on cause here in missouri you cannot move your children out of state,unless its not contested. you need to find out from your daugters dad if he has issues with that if he dont then youll have no problem if he does contest it get your MONEY ready you will have to fight it in court. but normally you will win your way GOOD LUCK TO YOU!!
