If the student commits it the student would be at fault. If the instructor told you to do something illegal then he would be at fault. If you knew it to be illegal and still did it then you both would be at fault.

The instructor.
After all, you are a student - expect to make mistakes. That's why you are there, learning from the instructor.
The instructor has the control on the passenger side.
They take that kind of risk to teach when they sign up to become instructor. So, clearly it is instructor's fault, regarless whether he told you to do something and you did not do it etc. etc.. etc..
That kind of argument does not wash.
Ask any insurance co. they will tell you the same thing.
After you get your license, you do something wrong - then obviously it is your fault. You are not a student anymore.

I doubt you could sue, yet you may desire to do some thing and speedy. for my section i could at modern-day hearth the instructor. i could even have any instructor sign an settlement that they don't look to be allowed to this element everybody else affiliated with the college. in in simple terms the final 10-12 years, i understand of two diverse martial arts faculties in Virginia that ended up remaining through instructors messing around with scholars. Neither ever opened returned. mixing scholars and instructors in any relationship or sexual way is often undesirable for the college. i had an instructor interior the mid 1980's that became relationship between the scholars. It led to me having to kick him out of sophistication. That led to the girl to end. Then numerous of their friends on the dojo end. All complete 5-6 scholars through fact my assistant instructor does not end relationship the student. He became warned numerous circumstances, over numerous months. What made i the area much extra risky became the reality that the Assistant instructor became almost 30 and the student became decrease than age....... get rid of the instructor in touch in the previous from now on harm is carried out to your classification. regrettably, you may possible get in criminal worry reckoning on what occurred and the place it occurred. **************** warning !!! seems that I fell for this question. Ignorance of the law is not an excuse. You must have an instruction or learner's permit before you start driving, which means you have passed the written test for your state. The instructor is there to monitor and to supervise your actions, not make decisions for you. If you screwed up, then it's your fault!
