why are child molesters seeming to get a break in the justice system by claiming insanity to under-go treatment when its only to avoid going to jail. why do these freaks get a break when they get caught molesting a child why not a severe penalty to meet the crime. just jail time wouldnt work imo.

Justice system is much too liberal, and everyone wants to be PC and "not be to hard on them" and "give them another chance". It mostly depends on the state however. In the north east and the west coast judges are much more liberal and it pains them any time they have to sentence someone to prison, even a serial killer.

In more conservative states like Texas, you will never see this happen. A criminal is a criminal, and if you do the crime you better believe you are doing the time. This may also contribute to their lower crime rates per-capita.

I don't believe in giving second chances to criminals, especially to someone who could just go out and hurt another child. Although liberals do not care at all about children, they will just call a child molester a "post-term fetus inspector", because "child molester" has a negative connotation to it and we don't want to offend the man.

Everyone needs to get tougher on crime. I think capital punishment should be given to ANYONE who commits a violent crime such as murder and rape. And if someone does not like it, guess what: don't commit the crime. It is as simple as that.

you used the correct word, 'seeming', you see it is a common mispreception of the populace that what you say is truth. when in fact it is only the common preception of truth.

i have worked in the criminal justice system, and the "insanity" plea that you speak of is so rarely used in any serious criminal defence that it is futile to attempt for a defendant. to my best recolection 'Hinkley' (the man that shot Pres. Ronald Regan) was the last person that successfully used the insanity defence. and the laws have been changed to make it harder after Hinkley.

You stated that said sex offenders are often given a 'break' and avoid jail by attending treatment. Again, you are mistaken, molesting a child under 12 is a 25 year prison sentence with a minimum time served of 85% of the term or about 22 years and 10 months, then a minumun of 2 years of supervised release after that. and mandatory treatment. is that a break. we in iowa have similar laws and punishments as the majority of the states. The conviction rate in iowa is very high, and there are few if any plea deals made on sex offensess in iowa that lessen the punishment.
in addition to the prison term and supervised release there is further punitive action by requiring the sex offender to register for a minimum of 10 years, or in some cases to register for life.

this is costing the tax payers a great deal of money, and still the public has the misspreseption that we are not doing all that we can to maintain saftey.

i just wish that people would investigate what we are doing in fact, and not believe the rumourus rhetoric of the ignorant fear mongers

It is more effective to separate child molesters from society by using long term mental health settings. They are a huge problem in prison systems. The attitude of the other cons makes putting them into population a death sentence which no one will accept. So they have to be isolated in a separate high risk environment. Sense few of these offenders are a physical threat to other adults they can be separated more effectively using the mental health system. If you think a forensic mental health unit is a better place to live in than a prison you need to visit both. My personal opinion is that real child molesters can not be cured and should be put to death after their crime was established beyond doubt. Note that I do not include statutory crimes in this group. They of course need a lessor punishment. I am not sure that public flogging would not make a good punishment for a lot of crimes. It is cheap, quickly done, and judging by Singapore quite effective.

You are correct, jail time has no effect on an illness of this nature. These people are NOT CURABLE and putting them in a jail cell only hides them away and builds their disease until we release them back into society.

Clearly no rational person would molest a child so there is some warrant to the 'insanity' plea. If they aren't crazy then what makes them prey on little children?? But I completely agree with you that they should NOT IN ANY WAY get a lighter sentence because of this sickness and the danger they pose to society.

My unpopular opinion is that if you committed a crime and have something that jail will not cure, that mental health professionals cannot cure (remember, jail is about REHABILITATION) and you are a danger to society then your life must be taken. There is no room on this planet for those that kill, murder, rape, molest anyone but especially children.

You are absolutely right. I have been asking this question for quite sometime. They get arrested... get out just as quick... then register. I am not sure why they get out of everything so easy, but I know that part of it is due to law. I mean, of course they are insane... not to mention sick. To claim insanity should be irrelevant. I think that they should serve serious jail time THEN go to treatment, even though I don't believe that it really works. That would be like putting a straight guy through treatments, for liking a woman.... either way, it's "how they are" and I don't believe that they can change. Maybe they can quit... but I don't ever see their minds changing. I agree with you, this should be treated way more seriously then it is, today.

People in criminal justice know that pedophilia is not a sickness that is curable, and that pedophiles have a very high recidivism rate. They do, when they get caught, get sent away for a long time. I still think that if a person is convicted of molesting a child or raping a child or a woman (in violence) then they should have a big R for rape or CM for child molester branded into their foreheads. That way at least we would be able to see them coming and protect ourselves and our kids.

What can jail 'cure' though?

One purpose of prison is for rehabilitation of ALL criminals.

Pedophiles tend to actually have a lesser recidivism rate than most other criminals and rehabilitation programs aimed at pedophiles DO WORK.

you are so right and unfortunetly people who murder get off on the same crap I live in Florida home of the largest nut house Chattahoohee and a numver of my relatives work there and they say none of the people there are crazy they just say that to get away from going to jail just like you said sometimes I wish that they would be like it is in other countries if you steal cut your hand off if you lie cut your tongue off if you kill you will be killed and if you cheat on your spouse you will be killed and best of all if you rape,molest,or doing anything bad like that they will tie you up blind fold you say a prayer for you soul and the family of the victim will blow you a** to hell that is the way it should be and I promise we wouldn't have such high crime rates and such high divorce rates that we do now
