Is There A Search I Can Do To See If They Been Taken,I Have Over 60 Sayings,And To Get A TradeMark On Them,Cost Alot Of Money

I listed some links where you can do some preliminary name checking. However, please be aware that this is merely scratching the surface of what's out there.

Only comprehensive research will tell you if the name is truly available. But, these links are free & a great place to start, so I'd try them out first.

Comprehensive research consists of looking at marks that are similar in Sound, Appearance or Meaning in the pending & registered Federal AND State trademark files as well as the US National Common-Law files.

There are other sites that offer free searching capabilities in conjunction with their commercial services, so I'm not able to post those links due to the Yahoo! TOS. You'll also want to check domain names & yellow pages, so simply do a search for "free domain name search" and "national yellowpages" and the appropriate links will pop up.

Yes, it's a lot and will take a large amount of time to search each phrase. But it's worth it if any of them are taken. "Ignorance is no excuse" it a popular phrase told to lawbreakers. Yes, they would come after you, and the fines are heavy. There is also jail time potential here if you had enough sayings that were trademarked or copyrighted.

Browse around the government sire to look at the different laws and penalties. I'm sure you will agree that it is better to spend the time now checking up on the sayings, than to be caught and prosecuted later.

If you use something that's already trademarked, you can be sued. If not, then you won't get in trouble, but anyone could steal the idea and you would have no way of stopping them.

You need to get a patent. You can be fined or jailed for not getting your business patented. You are going to have sayings on your shirts that might have come from someone else. It's better to be safe than sorry. Or in your case, out of business.
