Without pictures, video or witnesses, the wife has no case.

It's a tough one, depending how her married 'friend' witnesses it.
Also, unless the person to be sued has deep pockets, it is an exercise in frustration. That last was told me by an attorney during a free consultation when I was exploring to file such a suit.

Sounds like an ancient law that the legislature needs to repeal.

The traditional meaning of that law has been no sexual intercourse for a set period of time. Who wants to prove that Jane and John haven't had sexual intercourse .

Proof that the relationship existed and was damaged. Very hard to do unless both parties to the original relationship agreed on the facts.

photo's or date stamped video or hotel/motel receipts other eye witnesses to the alleged incident/incidents there can't be any he said she said crap 'cause that just cancels them both out.
I would suggest you tell your friend to tell her friend to tell his wife
nothing is going on or maybe he's using this to get away from the wife either way it really doesn't matter except in cases of divorce it's a civil matter that usually winds up in divorce court.
tell your friend good luck
