My latest thing: I am not allow to talk much during the work day because the sound of my voice annoys him. Is this even legal? I've been told that being mean to an employee or bullying an employee is not illegal, but should be. What would you do? I've tried not talking at all but it's about impossible to do my job without some sort of communication! (PS - this is just one of many things....there is also the fact he doesn't like my hair (it's curly) and he's flat out told me I'm not as smart as him....I could go on and on....)

First start to document every day what happens including the time of day and the comment, do not ADD any thing but :Mr. James told me I am not to talk:.
Second, keep a smile on your face at all times. It makes people scared of you.
2a-ask for your boss to pay for voice lessons.
Third, Do your job to the best of your ability and then even more. Give 110% every day.
Fourth, job discrimination is 90% unable to prove without facts. And even if you have the facts, it is always their word against yours.
Fifth, keep the faith that YOU are smart. You were smart enough to realize that you can do more. Start to look for a new job in something else.

Do you work at a large corporation or is your boss also the owner (or very close with the owner)? IF you work at a large coporation, then go directly to HR, and try to get reassigned. If you do not, then your only option is to find another job.

Unfortunately, it is not illegal to be an @sshole, but it is still illegal to shoot them. Wouldn't it be great if we could have an @sshole hunting season?

I think he wants you to quit. And then No State unemployment gets filed .... and he can wait until you normally get paid the money he owes you. Else if he fires you he has to pay all he owes you (within 3 days depending on State). And you could go down to the unemployment agency and file. That is what he trying to avoid.

Stand up to him and look for new job the world is too big has alot of opertunities no one has the right to be mean to u and no law can stop anyone only you can make sure that you are not pushed arround
