When applying for a new job can the company find out the reason for leaving your last job? Can they find out whether you resigned or were let go? Also, if you were in fact let go can they find out what you were let go for? I'm having an arguement with a buddy of mine and he thinks they can't find out. Anyone know?

What a former employer is supposed to say, and what one will say are two totally different things.

I used to sit next to the office manager at one company. She would say "Off the record I will tell you that so-and-so was only on time twice in a 30 day period after being given numerous warnings for tardiness." or "I could get in trouble for telling you this, but this employee was caught stealing from the petty cash, so we fired her."

So, to answer your question, what a potential employer can or can not find out is entirely up to the moral integrity of your previous employers.

Most job applications ask about last job and they also ask if you were laid off resigned terminated seasonal etc so I would guess yes they can. Why else would be on application? What you need is a good explanation as to why you can give in interview. However you cant blame them otherwise you will look like a troublemaker

Legally, no they can not tell another employer the reason you were let go, or quit.

However, who is completly leagal all the time first off and second off an employer can say good things about you, but not bad things so pretty much if they say good things then you left on good terms. If they choose to say nothing it is a dead giveaway that ie ended badly and they should possible reconsider hiring you.

I think your buddy is right. Have heard that a company can't report why one leaves their job for they can be liable if that person can't find work else where (because of the Company's negative info on them).

By law, a company cannot give a bad reference. They can refuse to give a reference which would lead your new employers to come to their own conclusions.

They can call your former employer and ask them,but all that most of them will say (that I have encountered) is that you worked there and if you quit or were terminated. I have never heard of them giving details.

They can find out if you left or where fired. But your previous employer can not go into details of what occurred that may slam you.

THEY can not find out what you were fired for...they can find out if you were let go or chose to go

They can find out by calling the company. If you don't want them to know, then don't list them on your application.
