Hoping someone can advise here. I have a tenant who has 3 dogs and 2 cats, and the dogs (apart from sleeping inside) occupy the yard. She won't leave the gate unlocked for my gardener to clean. And she wont return my calls. The only time she's responsive is if she needs something repaired. Then she instantly calls me and expects an instant response. Any ideas on what I can do to get her co-operation with the gardener? I'm watching in dread as my property deteriorates...

As always, the language of your lease controls. If it is your obligation to maintain the yard; then its the tenant's to allow you to do it. A tenant who prevents a LL from maintaining or caring for the leased property can be considered in violation of its lease. Bring the lease to your attorney & ask him/her what your options are.

What does the lease say? If you don't have a clause stating that you will handle the yard work and requiring her to allow access to the gardener then you probably can't require her to allow access now.

You do have the right to inspect your property at reasonable hours with proper notice and require her to maintain the yard properly.

If she's not abiding by the terms of the lease, send her written notification instructing her to either correct the problem (allow access to the gardener or maintain it herself) or to move out within 30 days. If she fails to do either, file eviction proceedings.

Note: Most leases require routine notifications to be in writing. Stick with written notice and require her to do so for non-emergency repairs.

Fine her or evict her. Or, leave her a message and say, The gardener is coming at X time. If you don't have the gate unlocked and the dogs inside, I will charge you his fee for the trip.

All you have to do is give her 24 hours notice to get access. She isn't required to 'give you permission."

Did you write into the lease that you would maintain the landscaping? I hope so...then you can use the 24 hour thing and you're good to go.
