I have a friend who just broke up with her boyfriend of 4 years, they have a 3 year old daughter as well, and the father is now taking my friend to court for full custody claiming that my friend is an unfit mother and that he doesn't agree with the way that she is raising her. Now, the problem is that my friend has a record for bouncing checks and forging a check and currently has no liscence.
So my question is, what are the chances of him actually getting custody of her? I love this child like my own, we were prego at the same time, our kids are 3 months apart, and i just really dont want my friend to lose custody of her daughter because i know how much mine means to me. :(

Anything is possible, but a judge won't award sole custody of a child to anyone based on the other party writing bad checks. Tell her to get an attorney, and to walk a straight line.

Hard to say, without seeing the entire case. But I would say chances are low that he would get full custody. Most states and judges do not like to take a child from the mother unless it is an unhealthy situation, such as drug use, a history of violence, neglect, or jail time.

It is completely possible, but most likely joint custody with them spliting the time the child spends with each one equaly.

Courts are giving fathers much more rights today than a few years ago.

Now does he really want the child or is this merely a way to hurt her. Children are often a tool used to hurt the other party.

Split custody with visitations TBD by the judge or mediator assigned to the case.

She can always countersue for child support - but that is in a different forum.

Are there any reasons why he SHOULDN'T get custody? If not, I'd say he stands as good a chance at getting it as she does (unless he is unfit or unstable).

he might get full custody with her having visitations... it depends.. usually they won't take a child away from its mother unless it's in diar conditions.... But then again.... a criminal record looks real bad........ it's going to be up to the mediator.

he has not chance, if he doesn't like how d child is raise its not a crime, on the other hand if she has a criminal record it might be a problem there no DL no prob. if she is a prost. no problem. remember drugs is a problem she will have no chance
