Because drinking is a commercial activity, and thus under the scope of the commerce clause. And because the 21st Amendment gave specific authority relative to regulating alcohol consumption.

Also, read the article and the quoted law. Congress could not and did not set the national drinking age as a matter of law. They simple bribed and blackmailed the state legislatures to do it, by threatening to withhold federal funding. Highway funds bear a rational relationship to drinking because of the common practice of drinking and driving.

Can you identify a commercial activity that Congress can directly link consenting sexual behavior to? Or link it to some area of federal funding that the Congress can threaten to withhold? If not, then it's outside the scope of Congressional authority.
