My husband is in prison for something that is totally stupid. I'm filing his request for an early release. But I'm not sure how to go about it. or the process it will go through.

Call the local clerk of the court; or better yet contact an atty or legal aid

First good luck if your courts are anything like the ones here.

I'm not sure but I know several people who have been in that situation and filed for judicial relase and I can ask them and try to find out.

I dont think you can do it for him, I Think he haves to. I think it involves him filling out some papers and writting a letter. Or such. check some law books on what is needed.

Depending on the charge and the amount of years he haves....You could also try to appeal for a "Resentensing hearing" However with that you take the risk of him getting the same time, less time or more time. Though in most cases its always less time or the same.

That depends on what state you live in, since each state has their own rules. It also depends on if he is county jail or state prison.
