It is recognized in States that are considered having been of Spanish Domain (call Social Security and ask to confirm which ones... California, New Mexico, Florida... I think); I do not know how long you must have lived with the other person, though. But, yes, particularly if you've had children or shared a live with the person for a PARTICULAR period of time.

I don't think you can. I don't think common law marriage are recognized in any state anymore.
