is there an income test that supercedes the amt in a sep agreement? do courts need to get involved if spouse is unco-operative?

It doesn't matter what you were paying before, it matters what the income $$ of the new Payer is.

For instance, if you made $60K/yr and were paying $500 a month and your wife earns $35K she will be paying $200K or so.

Good luck getting custody.In Missouri if you are a man, the only way to get custody is if the woman doesn't want the kids or she is dangerously crazy.Get custody because you want your kids with you,not because you want to create a new income.

Provided I read your question right, which I'm not sure I did, considering the new language you created :-) , You need to go back to court, espeacially if the other spouse is being a butthead about it.

It all depends on income. If your ex makes less money then you, her payments will most likely be less. If she makes more, you could get more. It all has to go through your lawyers and court all over again.

You can go through the state child support office. You do alot of the leg work but it would be submitted for you.

in new york if the non costodial parent who was paying child support now has custody he would than go to the child support unit and put in for an amendment asking for child support. he should get it if the child is still of age.
