Be carefull! Every state has different laws. If someone is brutally beating on you, yes you can defend yourself, but if someone comes up and smacks you in the face, it is better to walk away. IF there are witnesses, call the police right away and press charges against that person or get a restraining order. If you hit someone back and cause more damage than they caused you, you could end up with an assult charge, even though you did not start it.

As far as I know they have to go for you (not actually hit you, but move to) with no egging on your part, then you can use reasonable force to disable them.

If someone comes into your property you have to show them where your Playstation 3 and Xbox 360 are and give them a hand loading their van. You cannot use reasonable force, unless they threaten you - only call the police.

Get this checked out though...

Punching them back could easily lead of escalation and someone will come off much worse... Try to defend yourself and if possible restriain them and get help if someone is around. Only fight back if you feel you are being seriously threatened however if it seems like they could easily screw you over or they are not alone then it's probably better to run and live to fight another day...

You can as long as you did not use excessive force.

Actually, you can claim anything. If it goes far enough, it will be up to the judge or jury to decide. If you foresee a problem, get an attorney.

I think you can if you punch them immediatley after they attack you but you cannot use exessive force or you could be charged with assault.. Self defence is a very tricky concept & you ned to be very careful if using it in court.

"You feared for your life and retaliated rather than be beaten up or worse, killed." That's what I'd be saying. But personally, I'd have taken myself to the police and filled out a report, including what you said and let them figure it out. But if the guy takes you to court for punching him, then it's your word against his and whether or not he is a good enough liar to have you arrested.

Very grey area, but if you "genuinly feared for your life, wellbeing" then self defence can of course be claimed.

if you are in the UK then yes it is OK , the law states that if you feel that your in a situation where you feel you may be assaulted or you feel your safety is in danger then you can strike the first blow ! but only if you feel threatened , you may still get arrested but stick to the " i felt threatened " story and you will be OK . i know this from experience .

I think if they hit first, you're in a better position than them. However, if you then give them a beating, you wont get much sympathy, you have to prove you were defending yourself.

I think so long as you didn't hit first, unless of course you were verbally egging it on? not sure, a lawyer would be good one to ask.
