we live in california and she is 12 and he is 11 they bothh want to have it changed to my husband of 7yrs' last name their father has been out of the picture for the last 10 yrs no contact whatsoever any ideas where to start and i can't even contact him cause i have no idea where he is, last i heard he was in prison

their father has 3 other children and does nothing for them either my children have their fathers last name but their father has never supported them and has never even tried to contact them he knows where we live and our phone numbers have never changed my husband has supported them for 7 yrs is there for them thru thick and thin and my kids adore my husband they call him daddy their real fether has broken endless promises to them and they feel nothing towards their real father i have explained to them about how we make mistakes but they want nothing to do with their father and his family doesn't even care about them either and my husband adores these children with all his heart they mean the world to him

That's great that they like their stepdad that much. My kids are adults and my son STILL doesn't like my wife, oh well. Enjoy the happiness while you can.

Any man can father a child, it takes a real man to be a dad.

If these are the children's wishes, then by all means allow your husband to formally adopt the children. If you cannot locate their natural father by normal means of contact, then publish a legal advertisement stating intent in a local paper three consecutive times. If no response, then it is considered legal consent (double check with a lawyer, but I believe this still holds in CA).

I believe they can change their name without a problem especially if he is on the birth certificate. I would get a certified copy of their birth certificate, and then contact the juvenille court. The probably have a petition for name change. If not, maybe you can file a Notice of Name Change in the family court under the existing divorce case. I know they have forms for the spouse, I'm not sure about the children. You can also go on the Court's website, our the County's website, where you would go to get a certified copy of the birth certificate. The Court's usually have a facilitator's office that can help answer questions.

If he has had no contact with his children for a certain amount of time and not paid child support etc you can have him declared as a parent that has abandoned his children. Once this has happened he has no legal rights and then your husband can legally adopt the children and they can change their names. I'm not sure if this is correct in Cali but I would get into contact with family services or family law courts in your state and they may be able to steer you in the right direction.

Unfortunately, without the father's permission, it's going to be harder than all hell to change their names. You could go about it in another direction though and that would be to petition the court to strip the sperm donor of his parental rights and have your husband adopt them. In today's day and age, with so many children born out of wedlock, it's happening more and more.

your children make not good decision i believe in life we have only one blood dad even if he is not support his kid share the good times as well as the bad i thing every dad deserve his kid to hold his family name i don't believe 95% dad are bad to their kids it is only a mater of time COD be hope less we don't have to blame him frist you have to find him and find out what is wrong wez him that he must know about his kids what is going on in their daily life let kids love their dad tell them a good thing about him not bad thing i am sure at past you have a good life wez him to handle others use your heart anger is only one letter short of dangers
