I am remarrying my FIRST ex husband (yea, I know, it sounds very weird, but it's GREAT). We were divorced for 7 years and I had a child with someone else during that time. That parent is missing in action and I've not heard from him for over 6 months. I have no idea where he is and have no way to reach him. I have full custody and after I get married my husband and I want to change my son's last name to ours. I also have 2 children with the man i'm remarrying. It's important to all of us that the little guy has the same last name as the rest of us. How do I go about this? I have done a bit of searching and I see there is a form to fill out. But how do I advise the court of my childs biological fathers absence? My future husband has been in my son's life for the last 2 years and he calls him daddy. Thanks

your future husband could adopt your son as his own...instead of just being his "step-father"....a name-change is often part of the process

Hi I have some expereince on this under NH law it takes 6 months after filing in court to have this done if no reponse is heard you get the green light ,check local laws or contact attorney in your state to find out local laws , My daughter was a paternity suit I was that guy you ar trying to find ( not literaly )good luck

It depends on the state. You may not be able to change his name with out the father's consent.
