if I was discriminated against for a disability for getting a job and sued this company or firm what would I benefit
Would I get the job or a money settlement

I was told that I didn't get an interview because of being disabled ,but yet I was qualified for the position offered and they also supplied training

It wasn't used as a crutch
It was a position with the Town and the town manager told me face to face that if I were not in the disability status I would of got an interview.

I had a back injury but now could probably out perform most any male my age
I have been body building for 2 years,so they used the excuse that Im currently on S.S. and am not considered a good canidate,,even though the S.S. office has given me a ticket to enter the work force.

After a back injury it seems like no one has use for you anymore and you wonder why we stall home and collect....

Just because you are qualified, disabled or not, they do not have to hire you if there was another candidate that was equally or better qualified. Also, you have to be physically able to do the job, like be a quarterback. Who told you that you didn't get the interview because you were disabled, someone from the company in question? If it was someone from the company and the above doesn't apply, you could talk to an attorney. You won't get the job tho, you would only get a money settlement.

You would get a money settlement, it is rare that a company would be ordered to hire you.

I hire as part of my job, and since I don't know what your disability is, cannot comment on why you didn't get an interview.

There are lots of people who are qualified and don't get an interview, and I'm shocked that someone in HR would "tell" you it was because you were disabled.

If the company were able to prove that your disability did prevent you from doing the job (let's say, lifting 40 pounds and you are wheelchair bound), then you lose.

Since you didn't even make the interview cut, I think it will be a very difficult case to prove, since no one interviewing you would have been swayed by your disability - if you have it listed on your resume, (which is a bad idea), then they can use that as saying you couldn't do the job, but has to be provable.

it would have to depend---if it was during an interview process you would have to be MOST qualified---and since yo udon't know all of the applicants or their history you can't really say that you were the most qualified. Even with your disability you need to be able to do the job---or the job would have to be able to make REASONABLE accomodations for you----it all depends on your disability, how it would or would not hinder your ability to do the job and the qualifications of the other applicants---so technically someone who is equally qualified as you but does not have a disability that would hinder them in the job is really more qualified KWIM?

On the same note you can't assume that every job you don't get is because of your disability---you can't use that as a crutch (no pun intended) when an interview doesn't go your way---many things play into an interview such as attitude, your goals, if you'll fit in with the culture etc---not just job qualifications.
