According to the Federal Southern District Court of New York, it is illegal, even to back up DVDs you own for personal use. If you are caught, not much. Maybe a relatively small fine ($500-1000) to make an example out of you. No jail time. You won't get caught though.

They only enforce it against people who make mass copies of DVDs and sell them for profit. Now you are looking at large fines, disgorge of profits, and probably some jail time.

Caught by who?

For personal use, maybe nothing, or maybe a huge fine and or jail time.

Most commercail DVD's are copy protected and cannot be copied.

Nothing will happen because it is not illegal (ONLY if it is a backup for personal use AND you own the original).
If you don't own the original (say it's a rental) then it is illegal but they will never get to you!!
