Do I have to file Immigration documents for my child to come to the USA since the baby will not be born in the USA?

Dude....wow, you've got your work cut out for you. Technically, yes you can bring your financee and the baby to the US either before it's born or after but it's a difficult and time consuming process. Recent changes in US immigration from the Philippines since 9/11 have increased the processing time from 6-12 months depending on many factors. Bottomline, it isn't going to happen quickly and most likely the baby will be born before you can get an approved Financee or Spouse/Family VISA. I would recommend you start your quest by going to http://www.uscis.gov/graphics/index.htm There are thousands of online references and assistance to read, absorb and learn. I'm unsure of your situation or her's or her families so i will refrain from giving advice to you here. You can always email me directly and I'd be glad to help you in any way I can. I've got some experience there in Phil as well as some experience with the current immigration laws as i'm dealing with them now. Bottomline, it's not hopeless but to be successful you have to establish a plan for you THREE (you, your asawa and your child) and be dogged in executing it or your lady and baby will endure alot of unnecessary suffering. It's a tough world there in PI and single moms become victims without the support of you or her family (and most families will struggle to feed another mouth). Well as for my own personal experience..

You need to marry your fiance 1st in the Philippines..

Get yourself a Legal Capacity to Marry in the US Embassy.. Its a document they need in the Philippines when your marrying a filipina..

Don't worry about your child.. Your child will be an automatic American Citizen, since your an American like me.. You will just need to register your child's birth certificate in the US Embassy.

That's all.. Then when you come to the US.. Apply for a petition for your wife.

That's all..

Why didnt you practice safe sex pal? There is a chance her application will be turned down, and then we have another single mother in the Philippines....she will be ignored for life and left in poverty....if you really loved her, why did you give her that risk or getting knocked up without a guarantee she will be able to come and join you...I hope I am wrong and she can come, along with your new baby.... But still, shame on you!

Yes, you will have to file documents for the child to come to the USA. Your child will not automatically have US citizenship.

Your best bet is get her to the US, get married and start her paperwork to stay in the Country. Its alot easier when you are already married. The baby will be born in US and have automatic citizenship.

As long as one of the parents is an American, your child will automatically be an American too.
