yes,, insurance goes with the person not the automobile,,, if in your name you would share responsibility for any damage just as you would if you left the keys in the door to your house,, take your keys,,,

based on common sense, it would be the person's fault for leaving the keys in the car.

yes in colorado its illegal to leave a running car unattended. if its tolen though its a little different story
