If you don't file charges, possibly the c.c. co. may not see this as actually stealing, more of a conspiracy.
If you are legally seperated, no he can't use your card, did you have his name removed from the contract?
Seperate all ties, accounts, everything... call every credit agency that you have dealt with and make sure he is off the contract.

first step report it stolen. nowadays most credit card companys will give u ur money back as identiy fraud. but u have be officially divoreced. if u r not then u have to pay. other wise u can claim she stole it from u. best of luck

see an attorney, the $100 charge for a consultation will be worth it. follow his instructions. u should be able to avoid oweing it.
