First I would like to say Vodou is a religion not a magic system. Those that practice Vodou do not kill people. There are people called Bokors they are part of secrect societies sometimes associated with houses in Haiti that will curse, kill, hurt people for pay. This is not what Vodou is about.
I practice Vodou and we honor our ancestors, serve the lwa and serve God. We help our house members and the community by providing healing, food, money, whatever is needed. Now to answer the question. If it can be proven the person was killed by posin from a bokor or by mind power then yes convict. But I say how can you prove it?

Not legally in the US courts, though there were people imprisoned and killed for such back in the 1600s and 1700s.
The burden of proof is in the prosecutor. So, if the prosecutor could convince a judge to allow the argument (as a matter of law) and convince a jury to accept the argument (as a matter of fact), a prosecutor could attempt to argue causality through mystical means. It's like pushing a ton of jello up hill with one hand, but they can make the attempt.

The few cases that I have found addressing this (Cal, Penn, NH, MA) uses used the same type of actual-cause/concurrence analysis that I suggest, but those courts assumed as a preliminary matter that such non-physical mystic processes were impossible.

It would depend on whether or not you include poisons in the voodoo sect of the murders. Poisons (herbs),and such are used in voodoo or voudoun, so if you include that, then, yes I would have to say it is possible to be convicted of murder. As far as purely mental suggestions, I would have to say that would be pretty hard to prove in a court of law.

Some voodoo lady from Haiti was arrested in Florida last year for transporting a human head in her luggage. Don't know if that counts.
