i live in portland oregon... i want to knw what happens when you terminate a 1-yr lease when you've been resident only 1 month? The reason is an irreconcilable dispute with upstairs neighbor: we on the ground floor smoke in out pation vs. neighbor in 3rd floor claims ciggerette smoke gets up there endangering her health.
We tried to accomodate by smoking 9 yrds from our pation but the sniveling twit still complains

I worked for an attorney who handled landlord and tenant issues. They can't get upset because what you are doing is considered "Normal Living Conditions." If you feel this is a detriment to living, speak with your manager and he/she most likely can move you to another apartment for no fees.

Hi! We have had to sublease before. This is where you find someone to take over your lease for you. I had to put an ad in the paper and you say in the ad, "Sublet available for 2 bedroom apt" or whatever. Some people will like this because it means they wont have to sign a full year lease. Someone might only need it for a shorter time so they might want to take it over for you. Or, you could check and see if your apt building has a waiting list and see if your land lord is nice and will let someone who has contacted them to move in, take over your lease so you get out of it that way.

No matter what - even if you get a lawyer invloved, your landlord doesnt HAVE to let you get out of the lease. If it were that easy, why would they even have leases, ya know? :-)

But, I just wanted to say concerning your situation, why should you move? I think you are the innocent one here. If that lady has a problem with you smoking, that's just it - it's her problem. If she wants to move, let her move, but don't let her complaining "force" you to break your lease and then have to pay your rent for the next year when you're not living there. It'd be funny if the next people that move in smoke anyways and she still has to deal with it! LOL Really, you can do whatever you want to out on your patio, ya know? She could shut her window or whatever if it is really bothering her that much.

Maybe you'll luck out and the person complaining about your smoking will complain to the landlord and you'll be asked to leave.

Or you could approach the landlord yourself and say that your neighbor is complaining about your cigarette smoke. Explain that you are uncomfortable not being able to smoke in your own home and your neighbor is uncomfortable because she feels her health is being endangered. Offer to leave. You'll appear cooperative and helpful.

Don't break the lease without the landlord's permission. You could be sued for the remaining 11 months of rent and lose your security deposit.

A lease is contract. You can leave, but according to your lease I'll bet you still owe the money.
You can't control who your neighbors are anywhere.
