Gratuity is payable at the end of the tenure based on the last drawn salary. The employer is obligated to make the payment to the employee within 30 days and in case not so paid it should be deposited with the Gratuity Commissioner within 7 days thereof, else employer is liable for penal action. Where the employee is transferred from one so called Group Company to another, if he resigns and joins the other, then the first employer shall settle the gratuity. As a private arrangement, the differential amount could be paid as ex-gratia (taxable) when he finally leaves the "Group". Under law today there is no Group Company concept (unlike under the erstwhile MRTP Act) and so company being a separate legal entity, there can be no such transfers. Alternatively, the parent company could depute to other company, continue him in its rolls and claim reimbursement where, Service Tax and TDS may apply
