after 1year my attorney sent me a letter and said an audit has revealed i gave you too much money on the sale of your house and would appreciate a check at your earliest convenience

The appropriate statute of limitations has nothing to do with real estate but involves repaying sums paid to you in error. It is almost certainly longer than a year. If you discovered you lawyer had overcharged you a year ago, would you expect to be refunded the overpayment? Of course. It works the other way too. The law says erroneous overpayments must be refunded.

Your first step should be to request this so called audit and determine the facts then either pay or contest the audit.
