If you got hurt on the job you will be collecting workers compensation and cant file for unemployment as the workers compensation payment will count as income.

Generally you can only get unemployment if you are able to work. If you are injured then you do not qualify. However, you are eligible to receive workers compensation benefits. Specifically temporary total disability benefits for the time the doctor says you can not work or if you are released to light duty, until your company takes you back. You will get 66 2/3% of your average weekly wage of which you do not owe taxes so it should be pretty close to your regular salary. It does not matter who was at fault in the accident. Fault is not an issue for workers compensation. However, if the accident was not your fault, you should also be able to recover from the other driver, but this may take a while.

To be eligible for unemployment you must be ready willing and able to work. You need to file for state disability or Workman's compensation. If you are going to be disabled for 12 months or more you can file for Social Security Disability they will pick up after State Benefits end. Those are the rules in NJ don't know about your state but SS is Federal

It would be nice if you could, but unless they were real shits and fired you for the accident, you have to claim with the insurance company for workmen's comp. most if not all states require employers to pay into it, if they don't you can sue the heck out of them and get some extra cash, but I doubt that's the case.
You can also get some pain and suffering costs back, like going to the doctor or chiropractor, sometimes depending on the injury you may have other things you can do, I'd talk to an injury lawyer if I were you and see what your options are.

you need to file workers comp first. If that does not work you can file unemployment if your employer did not fire you and just laid you off.
