they say he did it for he really wants to be gay..
so is it a hate crime.. or a crime of passion ?

It is a hate crime. Crime of passion is frequently used inappropriately. For instance, rape is not a crime of passion, it is a control issue and has nothing to do with passion.

Passion is the emotion of feeling very strongly about a subject. In that sense you could say that all hate crimes are crimes of passion.

Rather than fearing the gay man, it is equally probably/possible that the attacker is just not comfortable in their own sexuality and hate/fear anyone who seems to be comfortable with their own.

Now we come to what hate is. On an emotional tone scale hate and anger are cover ups for fear. (think about that... when a child goes missing frequently when they are found the parent is furious with the child.. why? because they were terrified.. fearful.) They might not be aware of the fear, and unless and until they face their fear, they will continue to feel the anger/hate that causes them to act in socially unacceptable ways.

It's a hate crime. He feels threatened because he has to resist his own urges and over compensate to cover those urges up. Of course the homophobe probably would be able to accept his life if it wasn't for preachers and popes spouting hatred at gays and the whole LGBT community.

The only thing that matters in this case is if the person was beaten up(specifically targeted) because he was gay. If so it was a hate crime. The rest is conjecture and not a point of law.

First of all, I don't know who "they" are. Secondly, to me it would be a hate crime rather than a crime of passion. Crimes of passion usually involve overt sex, like when a man finds his wife in bed with another man.

a hate crime if you want to be gay why beat a gay man if anything you should ask him how did he tell his family and friends that he was gay

All "crimes" are based on some sort of "hate" operating.
In this instance, the straight guy doesn't necessarily want to become gay, but rather he is either fearful, ignorant or repulsed by the notion.

Everytime a gay person and a straight person has a fight, it does not necessarily have "hate" involved. And it isn't because someone really wants to be gay. That is some dumb thinking. But if the fight is because it is a straight person picking on a gay person, then he should get all that the law can give to him.
