my daughter is 3 now, and I have not forced support (or even started it) but now she needs surgery and I can't get her family medical history from her biological father's family becuase they believe she isn't his daughter.

If he isn't the father then how can they legally keep her medical history. Besides, the family doesn't physically poses medical histories, the hospital or clinic where she was treated does. Sounds like you need to determine paternity. Sue or threaten to sue for paternity and see how fast they offer help!

First off, you take the man to court and get a paternity test mandated by a judge. If it is court ordered, then the courts or your ex will have to pay for it. WHEN the DNA results come back stating that he is in deed the father, then he MUST provide a family medical history for her medical treatment.

I would go visit a family lawyer, and they will tell you what is needed to do all of this.

Call a lawyer and get the process started. Get DNA testing on the father. You should be getting financial support for your child until she turns 18.

Children and family services in your state will conduct all of that for you. Go to them to apply for medical assistance and tell them you would like to persue child support and proof of paternity. Most states take care of everything...
