My husband left me 3months ago, leaving me with our two children. He is not having regular contact with the children.. his own choice, and I don't know where he is. i want to divorce him but don't know what to do. Advice would be appreciated

you dont really have to know where he is....if you see a solicitor...they will track him down through his national insurance number, if he left you to cope with kids then yes divorce him, did he give you an explanation for why he was leaving? any man who walks ojut on his family is a coward....get rid of him and move on...my ex was exactly the same..yes you can divorce him, they will track him down...explain to the solicitor what eh ahs done...soon enough you'll be shut of this low life....good riddance to him

Dont do it yourself. The divorce that is! Don't bne amateurish about it. Go and see a Solicitor who can get financial help if hyou are eligible and the LSC can pay for enquiries to be made. Again, don't do it youself.

If you really want a divorce, do not delay. think of the children and having made up your mind do not waver whatever he offers. Do not re commence the relationship or you will be back to square one and maybe more difficult to prove your case. At present he is in desertion, he will try to see you again once he knows you are serious, don't do it.
See a good solicitor even if you have to spend some time finding one you can trust.

It's a bugger - but there are very few grounds for divorce in UK. THe only way you can divorce him is to serve a paper saying he is unreasonable - which he is by leaving you. He then has the option to contest it - this is the type of divorce that drags on through the courts and the only people that win in the lawyers!

If you separate, you have to live apart for two years and then mutually agree.

For abandonment - he has to be gone for over 5 years!

it takes a LONG time if he isnt willing to answer solicitors letters.

contact a family specialist solicitor. they will get the forms from the courts, and help you fill them in.

they will send the petition of divorce off to his last known address, and he has a certain length of time to respond. if he does not... you go through ANOTHER set of forms, again.. if he doesnt respond from his last known address etc... then its more forms and onto the next stage. It is declared in court (usually in their absence) that u wish to divorce him, and after that takes 5 years of no contact etc and repeated declarations. finally after 5 years, you declare it again and you get ur decre nici.

it is a long long very tough process... that is the way it was when i worked in the county court a few years ago for my work experience. so things may have changed a little - but the basics are the same.

If you cant wait that long, i advise a regulated Private Investigator who can try and find him.

if you can find him, the quickest time you can have a divorce in is 12 weeks - because of the 4/6 week waits between sending/recieving forms etc (there are time periods alloted to them)

Get in touch with your local citizens advice. if you cant afford a solictor/investgator, you can just DIY divorce. The forms you need are available at county courts and you can "swear" on a bible that its the truth etc at one of the little desks there.

CAB can also adivise you on maintenance availiable for your kids.

There are several types of divorce. The first is the obvlious he/she was caught being unfaithful and is very quick. When there are grounds like that it is clear cut. There is also just a time thing where after a certain amount of time you are divorced, i believe this is the type you need. I think it is 12 months (or 6). You need to see a family specialising solictor. They are not too expensive, did he leave his cheque book??

This is not an uncommon delimma....

You can file a divorce and have the information published in the newspaper of his last known area.. and using his last known address.. Talk to an attorney or get a do it yourself divorce kit sold at some book stores and online...

If you choose an attorney he/she will know what paperwork to file, if you do it yourself all the paperwork you need and full instructions are in the kit..

I have heard if you file for divorce and put it in the paper and there is not any answer from the other person, it will be automatically done after a certain amount of time.

I am sorry you are going through this.

Now don't that just beat all walked out a left his own children and no contact.Its not a problem just go and get it started may just take a little longer.Seek the Maxim for support.Get all the legal aid you can now they will get it back out of him.
You can run but you can't hide just remember that .Good Luck!!

Talk with the state and hire an attorney to process the papers and get it started. Then file them. I think there is a time limit for him to sign them or if he doesn't show up then I think the state rules in your favor. Go through your attorney and they can track him down thru work, taxes, etc... They will serve him the papers and file them with the state and then go from there. He should be paying child support!!!

contact legal aid or an attorney and they can tell you the proper steps to take, you can also file with the court yourself but you have to know what youre doing and in doing that youll have to file a legal notice in the paper looking for him thatll run for 30 days and if he doesnt answer then your proceed, but talk to a lawyer most give free advice or consultation, good luck and sorry to say but what a jerk to leave 2 kids, he is a pig and lol to you and the kids. take care.
