They are committing an act that would be burglary and assault if it were done in someone's home. They are criminals.

A criminal is a person who breaks the law. It doesn't matter what else they are (a hacker, a doctor or a priest) and it doesn't matter whether they have actually caused damage.

But, yes, by far not all hackers are criminals. For instance, I consider myself a hacker - yet I have utmost respect for the law. Originally, the term "hacker" was coined to indicate somebody who had deep understanding of something and could create unexpected solutions to difficult problems using his or her knowledge. Later, people started applying this term only to people who were knowledgeable about computers. Yet later (mostly because of the media) people started associating this term with people who circumvent the security of computers. Although the term "cracker" was originally coined for the latter, nowadays most people use "hacker" instead - thus the misconception that all hackers are criminals.

Hacker's are not the one's seen as criminals but the Crackers are.

If I have access to all your private information would you like that. Would you not consider me to be an anti-social element?

Every thing you have in this world have 2 faces.....
Its all depends upon how you see that thing.
Hackers if do something to harm people then we see them as criminal..
but my friend people are learning ethical hacking now days and companies are employing them so that they can test their softwares............to know if someone can hack their system/software...

They hack onto other peoples private internet accounts and can easily steal money from you, get information on you and even kill you if they get the right information.
