I need to know if I go to Tunisia and marry my fiance will he be able to return to the Unitied States as my husband???

According to US Immigration laws, he has to have a valid Visa. Since you are getting married in Tunisia, he doesn't qualify for a finacée visa, but does for a spousal or tourist visia. Both have their advantages and disadvantages. Spousal visas require are worded so that you take responsibility for him in case he cannot get a job. Tourist visas require that he has to show adaquate proof that he has a job here in Tunisia, that he will return back to Tunisia, and that he has enough funds to support himself while in America.

I am an American married to a Tunisian and have dealt with the Embassy many times. My husband was able to get a visa from the Embassy, but once we reach America, they give him a date by which he has to leave country. The best thing you can do for him is to start the application for him to become an American citizen soon after you are married (it takes a good number of months to go through). Then have him apply for a visa and see if he is granted one.

By the way, a marriage done in Tunisia IS valid in the US.

If you get married in his country he may be able to come back with you with a tourist visa but that is temporary. You will have to file for a permanent spousal visa with the US Embassy and go through the rigid steps that are necessary. They will do a security check on him, he will have to have a complete physical, he will need to show proof of your relationship, you will have to prove financial responsibility, and he will eventually has to have a final interview with the Embassy. This process may take up to 6 months and it is not gaurenteed that it will be approved. You may also want to consider a Fiancee Visa as this does not take as much time, probably 2 to 3 months. The process is the same as the spousal visa.

Contact US Immigration. I don't think he gets immediate citizenship until they do their investigation. The marriage has to be recognized in the United States as legally binding too.

it depends on wether the marriage in Tunisia is considered valid in the United States........... check into that.........
