Whoever owns the land, as long as the well isn't over 10m deep.
My title deeds of the land my house sits on sets out that I don't own anything below 10m, so I can't charge BP rent should they discover oil in my garden.
Not sure about the sky above; I might have to start charging the airlines!

it normally pays for the upkeep of the place where the well is,as some of these wells are very old and it cost to keep them in good order.
