When you open account with them they don't tell you about the high penaltie they have. They just talk good about there Bank. They supise you with they penaltie.

Oh boy do I know how you feel. Except my problem was with Charter One bank. I had a problem where they were reporting stuff late and then reporting other things earlier in their favor.
The case:
I pay 82 a month for life insurance and I was expecting the payment to drop on the 22nd into my account. I checked my acount at around 12:00 am on the 22nd and it had not dropped. I was also expecting a deposit to drop into my account on that day as well. I then went to bed and woke up later on the 22nd of August and checked my account and noticed that the payment for the life insurance had come in and the deposit had also dropped into my account. There was only one problem and that was that even though the payment came in for the life insurance on the 22nd they reported it as though it had came in on the 21st. That then put my account in the negative and then it was paid for on the 22nd. I then called the bank and told them that i knew the payment hadn't come in until the 22nd and asked if i would be charged an insufficient funds fee and they told me that i wouldn't because it was taken care of. I then had $59 in my account. I went and took $40 out of the atm, spent $6 at walmart and made a $10 internet transaction. When i got home I checked my account and I had around $2 in the bank. The next morning I woke up on the 23rd and noticed that they did charge me the insufficient fund fee and not only did they report it for the 22nd but they reported it as though it happened before the $40 atm withdrawal, $6 walmart fee, and internet transaction. Each transaction resulted in a $35 fee which came out to be $103 in fees. worse than that I had other payments coming in that I had the funds for but couldnt pay because it would just take away from the negative balance and so when those fees came in I was charged more insufficient fees.
I then called up to the bank and asked them why they had charged me when they told me that I wouldn't be charged. They asked me who told me that and I forgot to get the guys name so i didn't know. They then said that it was nothing that they could do . By this time my account was at -$235 and I felt like I was being taken advantage of. I then called my Prepaid Legal Provided Law firm and stated my problem. The secretary connected me to an attourney that specialized in this area of law and she had me fax over my checking statements, the brach address and said that she would call me back. When she called me back we went through all of the transactions and she then said that she would write a letter to the bank on my behalf and that she would send me a draft before she sent it off to the bank.
Here's what the draft said:
Please be advised that Mr. Hoy has contacted our office regarding the above account. Mr. Hoy has shown me his online statement. He informs me that the DDA CHECK in the amount of $82.00 that was processed on August 21 was supposed to be processed on August 22nd. The processing of that item one day earlier caused an insufficient funds fee and a continuing negative balance in his account. Mr. Hoy informs me that immediately upon noticing the item appearing on August 21st, he called the bank and was told by a Charter One employee that there would be no insufficient funds fee for this item. He made two transactions the next day relying on this representation by your employee. If he were not informed that there would be no fee, he would have accounted for this fee in his balance and not made these transactions. Teh resulting negative balance caused two preauthorized payments on August 23 to further overdraw the account.

On behalf of Mr. Hoy, it is requested that you reverse the $35.00 fee from August 22, 2006 and all subsequent fees resulting from this incident. Your assistance is appreciated.

that's the power of having access to a Prepaid Legal provided attourney. You see, when we call in we go to customer support but when an attorney writes a letter it goes to the legal department. At first there was nothing that they could do but now I have been saved a little over $170 in fees. Pay the penalty that you owe. Forget the attorney, and find a grammar teacher. Then you might be able to read the contracts you sign.

THAT is why I READ all the paperwork for the accounts that I open -- because I do NOT like to pay fees when the bank screws up -- and I KNOW that they will screw up.
